§ 4-36. Director.

    The Business Administrator shall be the Director of the Department of Administration and shall be a person of demonstrated executive and administrative ability. He shall, prior to his appointment by the Mayor, with the advice and consent of the Council, be qualified in terms of knowledge of and experience in accepted practice in respect to the duties of his office as hereinafter stated. The Business Administrator need not be a resident of the City of Atlantic City at the time of his appointment, but during his term of office he may reside outside the City only with approval of the Council. His term of office shall coincide with the term of the Mayor, and his annual compensation shall be fixed by ordinance.
    B. 
    Whenever and so long as there is a vacancy in the office of Business Administrator, the Mayor may serve as Acting Business Administrator without additional compensation, or the Mayor may appoint, with the advice and consent of the Council, another suitable person to act as Acting Business Administrator for a period of up to 90 days. Any such appointment shall terminate after 90 days unless the Council shall by resolution authorize one or more extensions. The Acting Business Administrator shall, for the time being, have all the functions, powers and duties of the Administrator.
    C. 
    Wherever there is the absence of the Business Administrator, the Assistant Business Administrator acts for and in place of the Business Administrator, notwithstanding § 4-35.
